1. ABOUT THESE TERMS

These Terms and Conditions apply to purchases made from Rebalance & Restore (“we”, “us”, “our”).

Rebalance & Restore provides digital educational and wellbeing resources, including online courses, workbooks, audio recordings, guided practices and other digital products relating to nervous system regulation, wellbeing, self-awareness and personal development.

By placing an order with us, you agree to these Terms and Conditions.

Nothing in these Terms affects your statutory rights as a consumer.

2. OUR DIGITAL PRODUCTS

Our products may include online courses, downloadable or streamed audio recordings, digital workbooks, PDFs, exercises, guided practices, educational materials and other digital resources.

The specific contents of each product are described on the relevant sales or checkout page before purchase.

We will provide the digital product substantially as described at the time you purchase it.

Digital products are supplied electronically. No physical product will be sent unless the product description expressly states otherwise.

3. ORDER AND CONTRACT

When you place an order, you are making an offer to purchase the product shown on the relevant checkout page.

Your order is accepted when payment has been successfully processed and we confirm your purchase.

You are responsible for providing accurate contact and email information so that we can provide access to your purchase.

4. PRICES AND PAYMENT

All prices are displayed in pounds sterling (£) unless otherwise stated.

The price payable is the price displayed at the time you place your order.

Payment must be made using the payment method available at checkout.

We reserve the right to change our prices for future purchases. Any price change will not affect an order that has already been placed and paid for.

5. DELIVERY AND ACCESS TO DIGITAL PRODUCTS

Digital products will normally be made available electronically following successful payment.

Where a course or other product requires access through an online account, access instructions will normally be provided by email or displayed following purchase.

You are responsible for ensuring that the email address you provide is correct and that you have reasonable internet access and a compatible device for accessing the product.

If you experience a genuine technical problem preventing you from accessing a product you have purchased, please contact us at the contact email address provided on our website and we will make reasonable efforts to help resolve the issue.

6. DIGITAL CONTENT AND YOUR RIGHT TO CANCEL

Under UK consumer law, consumers generally have a 14-day right to cancel contracts made online.

However, specific rules apply to digital content supplied immediately after purchase.

Where you purchase digital content and choose to receive access immediately, we will ask you to expressly consent to the immediate supply of the digital content and acknowledge that, once supply begins, you lose your statutory 14-day cancellation right in relation to that digital content.

Where the required consent and acknowledgement have been properly given and supply of the digital content has begun, the statutory cancellation right for that digital content will no longer apply.

If you do not provide the required consent to immediate supply, we may need to delay access to the digital content until the applicable cancellation period has ended.

Nothing in these Terms limits any other statutory rights you may have under UK consumer law.

7. REFUNDS

Where a statutory right to cancel applies, we will provide any refund required by law.

Where a statutory cancellation right has been validly lost because you expressly requested immediate supply of digital content and acknowledged the loss of that right, we are not required to provide a refund solely because you have changed your mind.

This does not affect your statutory rights where digital content is faulty, not as described, does not match the description given before purchase, or otherwise fails to meet the requirements of applicable consumer law.

If you believe there is a problem with a product you have purchased, please contact us as soon as reasonably possible so that we can investigate and, where appropriate, provide a suitable remedy.

8. YOUR DIGITAL ACCESS AND PERSONAL USE

Your purchase gives you a personal, non-exclusive and non-transferable right to use the digital product for your own personal use.

You must not:

• share your account login details with another person;

• sell, resell, sublicense or redistribute the product;

• copy, reproduce or distribute the course, workbook, audio recordings or other materials for commercial purposes;

• upload our materials to file-sharing websites, social media, membership sites or other public or private platforms;

• reproduce substantial portions of the materials for use in another course, programme, workshop or commercial product.

You may download or print materials where the product specifically permits this, provided they remain for your personal use.

9. INTELLECTUAL PROPERTY

All course materials, workbooks, audio recordings, written content, exercises, graphics, branding and other materials supplied by Rebalance & Restore remain our intellectual property or are used under appropriate permission or licence.

Your purchase does not transfer ownership of our intellectual property to you.

You may use the materials for your own personal learning and development, but you may not reproduce, distribute, publish, sell or commercially exploit them without our prior written permission.

10. EDUCATIONAL AND WELLBEING DISCLAIMER

Our digital products are provided for educational, informational and personal development purposes.

They are not intended to provide medical, psychological, psychiatric or other healthcare diagnosis or treatment and do not replace advice from a qualified healthcare professional.

Our content is not intended to diagnose, treat, cure or prevent any medical or mental health condition.

You are responsible for deciding whether a particular exercise, practice or activity is appropriate for you.

If you have concerns about your physical or mental health, or if an exercise causes pain, distress or other concerning symptoms, stop the activity and seek appropriate professional advice.

11. NO GUARANTEE OF PARTICULAR RESULTS

Our products are designed to provide education, tools and practices that may support personal wellbeing and self-awareness.

Individual experiences and results will vary.

We do not guarantee that a particular product will produce a specific outcome, improvement or result for every customer.

12. COURSE AND PLATFORM ACCESS

Where access to a course or digital product is provided through an online platform, access is subject to the availability and functionality of that platform.

We will make reasonable efforts to maintain access to purchased products, subject to necessary maintenance, technical issues and circumstances outside our reasonable control.

If we make significant changes to a product or platform that materially affect your purchased access, we will take reasonable steps to address the issue.

13. THIRD-PARTY SERVICES

Some products may use third-party platforms or services to provide access, payment processing, email delivery, audio hosting or other functionality.

We are not responsible for temporary interruptions caused by third-party systems outside our reasonable control.

14. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, we are not responsible for losses that are not reasonably foreseeable or for business losses where you purchase our products as a consumer.

Nothing in these Terms affects your statutory rights.

Our Privacy Policy explains what personal information we collect, why we collect it, how we use it and your rights in relation to your information.

If you are a consumer, you will also retain the protection of any mandatory consumer rights that apply to you under the law of the country in which you live.

Nothing in these Terms is intended to remove, restrict or exclude any rights or remedies you have under applicable consumer protection legislation.

Where digital content does not conform to the contract, consumers may have statutory rights and remedies under applicable UK consumer law.
